Modern Moto specializes in aftermarket parts, upgrades, and accessories for electric dirt bikes, electric motorcycles, and related powersports vehicles.

Product compatibility is the customer's responsibility.

While we strive to provide accurate product descriptions, specifications, and fitment information, customers are responsible for verifying compatibility with their specific vehicle, model, year, and configuration before purchasing or installing a product.

If a pricing or inventory error affects an order, we may contact you to offer an alternative or cancel and refund the affected order.

4. Orders & Payments

We may cancel or limit orders reasonably suspected of fraud, unauthorized resale, or other prohibited activity.

If an order is canceled after payment has been captured, Modern Moto will issue a refund for the canceled items to the original payment method.

Payment transactions are processed through Shopify and its supported payment providers, subject to their applicable terms and security procedures.

5. Shipping & Delivery

Modern Moto works to process and ship orders as efficiently as possible.

Processing times, shipping estimates, and delivery dates are not guaranteed unless expressly stated otherwise.

Shipping times may vary depending on product availability, order volume, carrier operations, weather conditions, and delivery destination.

Modern Moto is not responsible for delays caused by shipping carriers, customs processing, natural disasters, or other circumstances beyond our reasonable control.

Customers are responsible for providing accurate shipping information. Additional shipping charges resulting from incorrect or incomplete addresses may be the customer's responsibility where permitted by law.

Risk of loss and responsibility for delivery are governed by applicable law and the shipping terms presented at checkout.

If your shipment is lost, damaged, or missing, please contact us promptly so we can assist with the carrier investigation and any applicable claim.

6. Returns, Exchanges & Refunds

We want our customers to feel confident when purchasing from Modern Moto.

All returns and exchanges are subject to our published Refund & Return Policy, which forms part of these Terms.

Unless otherwise stated in that policy:

Return authorization must be requested before sending merchandise back.
Products must be unused, uninstalled, and returned with their original packaging and included components.
Items showing evidence of installation, modification, damage, or misuse may be ineligible for discretionary returns.
Custom-made, personalized, and special-order products may be designated as final sale before purchase.
Original shipping charges and return shipping costs may be non-refundable, except where required by law or our policies.

Defective, damaged, or incorrectly shipped merchandise will be handled according to applicable consumer protection laws and our published policies.

Unauthorized returns may be refused.

Modern Moto sells aftermarket performance parts and accessories that may alter a vehicle's handling, performance, operation, or safety characteristics.

Customers acknowledge that:

Certain products may be intended exclusively for off-road or closed-course use.
Modifications may affect manufacturer warranties, insurance coverage, or compliance with local regulations.
Incorrect installation may result in equipment failure, property damage, or personal injury.
Professional installation is recommended when appropriate.
Protective equipment and responsible riding practices are strongly encouraged.

Customers are responsible for understanding and complying with all applicable laws and regulations concerning vehicle operation and modifications.

Products should never be installed or operated in a manner that compromises vehicle safety.

Modern Moto does not represent that every aftermarket product is approved for public-road use.

9. Assumption of Risk & Limitation of Liability

Operating electric dirt bikes, motorcycles, and other powersports vehicles involves inherent risks, including the possibility of serious injury, property damage, or death.

Customers are responsible for the safe installation, inspection, maintenance, and operation of products purchased from Modern Moto.

To the maximum extent permitted by applicable law, Modern Moto will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use our website or products.

Nothing in these Terms limits liability that cannot legally be excluded, including liability arising from conduct or product defects for which applicable law prohibits exclusion.

The Modern Moto name, branding, and slogan "Build Up. Ride Modern." may not be reproduced or used commercially without prior written authorization, except as permitted by law.
